Summary


Order Acceptance by PeeryPC, Inc/Acceptance of This Agreement by You: All orders of Products placed by you with PeeryPC,Inc shall be subject to acceptance by PeeryPC Inc. Notwithstanding any order confirmation or other communications sent by PeeryPC Inc, your order shall not be deemed accepted by PeeryPC Inc until PeeryPC Inc. shipment of the products ordered. Your submission of your order shall constitute your full acceptance of these terms and conditions.
IF YOU DO NOT ACCEPT THESE TERMS, PLEASE DO NOT SUBMIT AN ORDER.
PeeryPC Inc. is not responsible for delays outside of our immediate control, including delays related to order processing or unexpected increase in demand. Typically only orders paid for by credit card receive credit approval on the same day the order is placed. Orders delayed due to order processing will default to an Estimated Ship Date 30 days from the date credit is processed and the order is released. Estimated Ship Dates are based on any known extended lead times.

 

1.      1.      Absolutely no refunds after 30 days.

2.      2.      Shipping and handling charges are nonrefundable.

3.      3.      Canceled orders are subject to 5% restocking fee.
All refused orders buy customers are subject to 15% restocking fee,shipping charges is not refundable. Sales on Special Order merchandise are final -- no refunds. Special Orders which are not picked up within thirty (30) days of notification will forfeit deposit.

4.      4.      $20.00 charge on each returned check and finance charge of 1.5% per month for past due accounts.

5.      5.      Return merchandise requires valid RMA# clearly marked on box, copy of invoice and brief explanation of problem. Please refer to Terms & Conditions for complete Return Merchandise Policy.

6.      6.      Customer is responsible for all legal & collection fees to this invoice.

7.      7.      All claims for shortage, damage or shipment errors must be made within 3 days after receipt of shipment.

8.      8.      The limited warranty does not cover any losses or damages that may occur as a result of the following:

 

1.      -          Damage during shipping, (contact shipping company IMMEDIATELY)

2.      -          Improper installation or maintenance

3.      -          Misuse, neglect or improper environment

4.      -          Any modification, repair, adjustment or installation options

5.      -          Parts added by anyone other than PeeryPC, Inc.

6.      -          Excessive or inadequate electrical power, or electrical surges

7.      -          The breaking of certain seals

 

This invoice from PeeryPC, Inc. (PEERYPC) is subject to the following terms and conditions.

 

9.      1.      This product is warranted to meet applicable specifications (as set forth in the product description in the technical manuals) and to be free from defects in materials and workmanship under normal use and service for a period of one year from the date of purchase from PEERYPC. This limited warranty ONLY applies to those items not covered by manufacturer. All items under manufacturer’s warranty must be registered and serviced through their warranty agreements.

 

The express warranties set forth herein are lieu of all other warranties expressed or implied in no event will PEERYPC be liable to customer of the user for damages, including any lost profits, lost savings or other incidental or consequential damages arising out of the use or inability to use such product, even if PEERYPC has been advised of the possibility of such damages, or for any claim for any other party, in any event, the liability of PEERYPC shall not exceed the purchase price of the product.

Customers agrees to indemnify and hold PEERYPC harmless from any and all liability, loss or damage described in the preceding paragraphs of this section (except for the sole and exclusive remedies stated above), and from claims by any party for personal injuries or death or damage to property (tangible or intangible) arising out of the existence or use of the Products or any defect in the Products, whether or not such liability, loss, cost, damage or claim is occasional in whole or in part by any actual or alleged act or omission of PEERYPC, its representatives, employees, subcontractors, vendors, or suppliers, or by any defect in the Products whether or not it is contended that PEERYPC contributed thereto in whole or in part or was responsible therefore by reason or non-delegable duty.

10.  2.      Return Merchandise Authorization (RMA) Policy/Procedure.

  

All returns must be authorized by PeeryPC Customer Service or PeeryPC Technical Support. Before returning product, obtain RMA # from PeeryPC Customer Service by calling 1-440-439-0110 or faxing RMA Request Form to 1-440-439-0110.

 Customer must provide the invoice number, date of purchase, and serial number of items to be returned, and reason for return. (Please keep a copy of your invoice in case a return is necessary.)

  RMA numbers are valid for 15 days from the date of issuance. Returns must be received by PeeryPC within the time. After 15 days, a new RMA # must be obtained.

 Product to be returned must be securely packaged, preferably in the original cartons. Freight and insurance are the responsibility of Customer. Customer assumes risk of loss or damage during shipment.

 The RMA # must be clearly marked on the shipping label of each carton. (Do not put RMA # on product.) Packages without the RMA# on the outside will be refused.

 Products being returned for credit or exchange must be returned complete, including registration card and all accessories (cables, manuals, diskettes, etc.) , in original packaging. Product must be in like-new, resellable condition. All products will be inspected and, at our discretion, credit may be refused.

 No return for credit or refund for opened software (disk envelope seal broken or seal on Microsoft OEM Distribution Pack broken).

For products being returned for Warranty Repair/Replacement or Out of Warranty Repair, ship only the defective part, unless otherwise instructed. Customer is responsible for freight and insurance charges to and from PeeryPC for out-of -warranty repairs.

 

Certain products are serviced directly be or returned directly to the manufacturer. PeeryPC Customer Service or PeeryPC Technical Support will provide the necessary information for these products.

 

All Refunds/Credit must be approved and will be subject to a minimum 15% restocking fee. No Returns/credits will be replaced immediately. PeeryPC reserves the right to thoroughly test all items. Absolutely no Refunds/Credits after 30 (thirty) days from date of invoice. Allow 4 - 6 weeks from date of RMA for refunds.

 

11.  3.      All products are shipped at Customers risk, and PEERYPC’s responsibility for damages to Products ceases when the Products are delivered to the carrier. To Customer or to Customer’s agent at PEERYPC’s facility, whichever occurs earlier (“Delivery”).

 

12.  4.      PEERYPC shall not be liable for any failure or delay in the performance of orders or contracts, or in the delivery or shipment of Products, or for any damages suffered by Customer by reason of such failure or delay, when such failure or delay is, directly or indirectly caused by, or in any manner arises from fires, floods, accidents, riots, war, governmental interference, labor difficulties, delays in deliveries by PEERYPC’s suppliers or any other cause or causes (whether or not similar in nature to any of whose herein before specified) beyond its control. PEERYPC reserves the right to cancel without liability any order, the shipment of which is or may be delayed for more than 90 days by reason of any cause or causes beyond its control as aforesaid. PEERYPC reserves the right in its sole discretion to allocate among customers or potential customers or defer or delay the shipment of, any Product  which is in short supply.

 

13.  5.      Any software included in or relating to the Products has been supplied by the manufacturer, PEERYPC makes no representation or warranty with respect thereto and shall have no liability in connection therewith. Customer is solely responsible for complying with manufacturer’s or other requirements with regard to proprietary and similar rights in and to such software (including any requirement to enter into a separate license agreement  and prohibitions against duplicating and/or disclosing and shall indemnity  PEERYPC against and hold it harmless from any and all liability, cost or expense arising from a purported breach of such requirement.

 14. 6.      Sales on Special Order merchandise are final – no refunds. Special Orders which are not picked up within 30 days of notification will forfeit deposit.
